The Property Management Services Authority (PMSA) held a focus group meeting today to collect views from over 30 representatives of 13 industry associations on the two upcoming codes of conduct and the relevant Best Practice Guides to be issued for the property management (PM) industry entitled, “Handling Moneys Received on behalf of Clients by Property Management Companies” and “Obligations of Property Management Companies in respect of the Ending of Their Appointment”. It is envisaged that the two codes of conduct will be gazetted and take effect in the second quarter of 2021.
Due to the situation of novel coronavirus epidemic and to maintain social distancing, the focus group meeting was held online.
The licensing regime for property management industry (Licensing Regime) has come into operation since August last year. In order to enhance the professionalism of PM companies (PMCs) and PM practitioners (PMPs), the PMSA has issued codes of conduct and relevant Best Practice Guides for different PM areas to provide practical guidance for the industry.
Mr Tony TSE, the PMSA Chairperson said, “The codes of conduct and the Best Practice Guides are formulated in consultation with the PM industry, owners’ organisations, the Independent Commission Against Corruption, as well as the Consumer Council, to ensure that the codes and guides are more comprehensive and practical.”
The PMSA has issued three codes of conduct within the six months after the implementation of the Licensing Regime, including “General Code of Conduct”, “Complaint Handling Mechanism of Property Management Companies”, as well as “Effective Control over Property Management Business by Property Management Companies”. The PMSA will timely issue other Codes of Conduct and Best Practice Guides covering different PM areas as appropriate in order to provide the industry with guidance, including but not limited to:
- Handling instrument of appointing proxy regarding meetings of corporation / owners,
- Provision of prescribed information and financial documents to clients,
- Anti-corruption,
- Handling emergencies,
- Personal data protection,
- Managing scaffolding works to be carried out in properties,
- Carrying out procurement for clients, and
- Managing distribution of promotional materials in properties.
